Service availability may vary based on location, scheduling, staffing, weather conditions, and project requirements.

PRODUCT AVAILABILITY

Our online inventory changes frequently. We do not guarantee that any specific item will remain available until an order has been completed and payment has been successfully processed. We reserve the right to limit quantities, discontinue products, or modify pricing without prior notice.

PRICING

Retail merchandise pricing is displayed on the applicable product listing at the time of purchase.

Pricing for landscaping, maintenance, repair, cleanup, pickup and delivery, consulting, and other project-based services is determined following consultation and evaluation of the requested work. Project pricing is based on the scope of work, labor, materials, equipment, scheduling requirements, travel, and other relevant business considerations.

PAYMENT TERMS

Payment for online merchandise is due at the time of purchase through our secure payment processor.

Service projects may require a deposit before scheduling begins. Remaining balances are due according to the written estimate, invoice, or service agreement. Certain projects may utilize milestone payments depending upon the scope of work.

Invoices are due upon receipt unless a different payment schedule has been agreed to in writing.

LATE PAYMENTS

Past due balances may be subject to reasonable late fees or interest permitted by applicable law. We reserve the right to suspend future services until outstanding balances have been paid in full.

SERVICE ESTIMATES

Written estimates are provided for planning purposes and remain valid for the period stated on the estimate. Changes in project scope, customer requests, material costs, weather conditions, site conditions, or unforeseen circumstances may require adjustments to pricing.

SCHEDULING AND CANCELLATIONS

Service appointments are scheduled based upon availability.

Customers requesting cancellation or rescheduling should notify us as early as reasonably possible.

If work has already begun or materials have been purchased specifically for a customer's project, reasonable charges may apply.

We reserve the right to reschedule appointments because of severe weather, unsafe working conditions, equipment failure, supplier delays, or circumstances beyond our reasonable control.

REFUND POLICY

All merchandise sales are final.

Services are customized to each customer and project. Once services have been performed, payments are generally non-refundable except where required by law.

If LS & B.E.R.M. SOLUTIONS INC. determines that a billing error occurred, we will promptly correct the error and issue any appropriate adjustment.

SERVICE AGREEMENTS

All off-site services shall be discussed, agreed upon, documented in writing, and approved by both LS & B.E.R.M. SOLUTIONS INC. and the customer before work begins. Any modifications to the agreed scope of work must also be approved by both parties.

CUSTOMER RESPONSIBILITIES

Customers agree to provide accurate information, maintain safe access to the work area, obtain any necessary permissions or approvals, and cooperate throughout the project. Delays caused by customer actions may result in additional scheduling or project costs.

INTELLECTUAL PROPERTY

All website content, graphics, logos, text, photographs, designs, and other materials remain the property of LS & B.E.R.M. SOLUTIONS INC. unless otherwise indicated. Unauthorized reproduction or distribution is prohibited.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, LS & B.E.R.M. SOLUTIONS INC. shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website, products, or services.

Our maximum liability for any claim shall not exceed the amount actually paid by the customer for the applicable product or service giving rise to the claim.

Services are performed using reasonable care and professional judgment. Results may vary depending upon existing property conditions, weather, customer maintenance, manufacturer specifications, and other factors beyond our control.

WARRANTIES

Unless expressly stated in a written agreement or required by law, products and services are provided "as is" without additional warranties of any kind. Manufacturer warranties, if applicable, remain the responsibility of the original manufacturer.
